What Is the Case Limit in Small Claims Court?

Small claims court fees will not be permitted to exceed the limit allowed in your state. There is no federal limit, and each state is free to establish its own. Certain restrictions may be exceeded in certain circumstances. In Massachusetts, for example, the maximum award in a small claims court lawsuit is $7,000, but there is a provision that indicates there is no limit if the harm was caused by a motor vehicle.

Limits in Small Claims Court

It is simple to determine the maximum allowable claim. To find out what your local boundaries are, contact your county courthouse. Local government websites often include small claims court restrictions and are an excellent resource for filing and printing filing forms.

If you talk with or ask a lawyer, they will be able to clarify the local regulations regarding the maximum monetary worth of a claim.

Even if the expenses exceed the maximum, small claims court charges may be applied to the final settlement. Costs needed to prove a case are often added to the settlement sum.

Small claims court limitations may be as low as $2,500 in Kentucky and as high as $25,000 in Tennessee.

Filing should be done in a local county courthouse, where the clerk can answer any questions you may have. Clerks will also inform you whether there are any exceptions to the restriction that would enable the limit to be eliminated, allowing for a larger monetary value. A clerk can also answer any questions you have about the statute of limitations and serving court papers on the defendant.
