If you are facing foreclosure in Louisiana, you will almost certainly face a “executory” action. The foreclosing lender files a foreclosure petition with the court, and the court seizes and sells the property. In contrast to a judicial foreclosure (in which a standard lawsuit is filed), you may only fight the foreclosure by appealing or filing a separate case. If you lose your house in this way and the selling profits are insufficient to meet the outstanding debt on your mortgage, the lender may sue you to collect the difference (called the “deficiency”).
