Managed Document Review: Reducing Time and Costs in Legal Operations

However, this process can be time-consuming and expensive if not managed efficiently. To reduce time and costs in legal operations, several strategies and technologies can be employed:

Technology-Assisted Review (TAR): TAR, also known as predictive coding, involves using machine learning algorithms to categorize and prioritize documents based on their relevance. The system is initially trained by human reviewers who code a sample set of documents. As the reviewers code more documents, the algorithm improves its accuracy, allowing it to predict the relevance of other documents efficiently. TAR significantly reduces the number of documents requiring manual review, thus saving time and costs.

Data Sampling and Prioritization: Not all documents are equally important to a case or project. By implementing a sampling strategy, legal teams can focus on reviewing a subset of documents, representative of the whole dataset. Prioritizing review based on document relevance can further optimize the process and allocate resources more effectively.

Outsourcing and Managed Services: Engaging external vendors with expertise in managed document review can provide access to specialized resources, technologies, and streamlined workflows, potentially reducing costs and time spent on the process.

Continuous Learning and Improvement: Analyzing the outcomes of document review projects and identifying areas for improvement can lead to better processes in the future. Implementing lessons learned from previous cases can enhance efficiency and effectiveness over time.

Early Case Assessment (ECA): Conducting an ECA allows legal teams to gain insights into the case early on, enabling them to make informed decisions about case strategy, potential settlement, or further investigation. This approach can help prioritize review efforts and reduce unnecessary work on irrelevant documents.

By incorporating these strategies and leveraging technology, legal teams can significantly reduce the time and costs associated with managed document review, ultimately improving overall efficiency and accuracy in legal operations.
