Resolving OSHA Complaints

 

An inspector may contact you if you are the subject of an OSHA complaint or complaints. Sometimes an inspector may come up unexpectedly at your firm. Your reaction to both scenarios should be similar.

Pay attention to the inspection and be kind. Yet, until you’ve had a chance to investigate, avoid asking questions, confessing to, or giving your side of the story. Inform the inspector that when you obtain a copy of the inspection letter, you will evaluate the indicated accusations. You have 5 days from the day you receive this letter to reply to the charges.
After receipt of the letter, publish a copy on your employee bulletin board in accordance with OSHA’s guidelines. Fill out the given “Certificate of Posting” and fax it back to OSHA right away.
Examine the OSHA regulations listed in the letter, examine the charges, decide whether the allegations are valid, and rectify the hazard if necessary.
Create a response letter in which you describe the facts regarding the claimed danger as well as the efforts you have taken to rectify it. Gather and submit any necessary paperwork. The goal of this letter is to end the case, therefore offer them no reason to pursue the matter further. If your answer is sufficient, OSHA will usually conclude the inspection.
