The First Step

The first step is to determine if your matter may be heard in small claims court. The amount of monetary damages or money owing by the defendant determines this. You may look up the limitations in your state online or call the local courts.

If you are certain that the defendant owes you money, you must first seek repayment in writing via a certified letter. This will serve as evidence that the defendant is aware that you are seeking money owing to them. If the defendant does not respond to your letter, you must file a lawsuit.

The Following Step

The next stage in submitting your claim is to find out who the defendant is. You must present the following:

If the defendant is a person, his or her entire first and last name.
If the defendant is a company, the precise legal name.
