Knowing what is in your medical records may help you and your family get better, more effective health care in the future. You have the right to see your own medical records at any time, whether they be doctor’s notes, medical test results, lab reports, or billing information. You may also lawfully request your child’s medical records, but unless you are the patient’s legal guardian, you will require the patient’s written authorization to the health care provider. You also have control over who else can view your records.
Most adult medical records are retained for at least six years by the health care provider, however this varies by state. After your child turns 18, his or her medical records are kept for three to ten years, depending on the state.
Requests for hospital records (or records from other medical institutions) should be made directly to the facility. Ask your primary care physician or the doctor who ordered the tests for any diagnostic test reports, since the lab will not provide them to you directly. If your doctor’s office shuts or is sold, your records should be retained for at least 10 years, however you may need to contact the state department of health to find out where they are held. You may be refused access to some medical data, such as your mental health records, if your physician believes that seeing your records will be harmful to your physical health.

The permitted cost of medical records is governed by state legislation. If you are unable to pay the cost, write a handwritten note explaining that you are unable to pay for the documents, and the supplier will usually give you your data free of charge.
